We will endeavor to provide a continuous high quality service. If youexperience problems with your service, you should consult our support team onsupport@whizzihosting.co.za.

Please note, we may require suspension of some of our services for shortscheduled periods to carry out maintenance or repair to our services. We willgive you feedback on any problems as soon as possible.

Service Abuse - Spam policy

We reserve the right to terminate your hosting account if it is found thatthe resources made available to you on your hosting account are being abusing .Examples of abuse:

Spamming - Sending unsolicited mail.
Providing free file storage services.
Providing free email services via your website.

We will not allow spam to be generated from our machines - if it is foundthat a site is sending out spam emails regardless of how it is done (scripts,SMTP, contact form header injection etc) We will suspend the said account untilwe have assurance from the customer that it will not continue. Repeat offenderswill be irreversibly terminated.

Affiliates of Services

Customers may resell our services by displaying our Banner on there website,and earning commission from it.

Contract Period

Unless otherwise stated the contract period is on a monthly bases,termination can occur at any point during the month, There is no cancellationnotification period, hence cancellation will happen on the day of the requestprovided all amounts owed to us are paid. If there is still an outstandingamount the account will continue to be billed until the account is settled andthe cancellation request is resent.

High resource use policy
Resources are defined as bandwidth, processor utilization, memory or diskspace.

Whizzihosting.co.za may implement the following policy to its solediscretion:

When a website is found to be monopolizing the resources available whizzihosting.co.zareserves the right to suspend that site immediately. This policy is onlyimplemented in extreme circumstances and is intended to prevent the misuse ofour servers. Customers may be offered an option whereby AmpleHosting.co.zacontinues hosting the website for an additional fee or the client may choose toupgrade to a (semi-)dedicated plan.

Uploads via scripting languages
We limit uploads made via scripting languages - including PHP, ASP and ASP.NET- to a maximum of 20 MB per file.

Cron Jobs: Cron jobs may have an interval of no less than 5 minutes.

Payment policies
All accounts are set up on a prepay basis. Although AmpleHosting.co.za reservesthe right to change prices of accounts or services at any time, all pricing isguaranteed for the period of prepayment. Payment is due every 1, 3, 6 or 12months depending on the hosting plan you're on. Payment must be made within30days of the invoice date. Customers will automatically be charged again atthe end of their prepay period unless closure notification has already beengiven via confirmed receipt of an email to us.

In situations where the card number or debit order details on file aredeclined whizzihosting.co.za will have suspend the facility to purchaseservices on-line if payment is not received within 5 working days of notice topay the account. Whizzihosting reserves the right to suspend other servicesuntil the any outstanding debt is cleared. The customer is responsible for allmoney owed on the account from the time it was established to the time that thecustomer sends an accepted written cancellation request (refer to"Contract Period" above).

There will be an administration fee of R100 on all unpaid transactionsprocessed via debit order or credit card. (insufficient funds/invalid accountnumber etc)

Should your account fall into arrears (over 30 days) we will suspend theaccounts you have with us. A re-establishment fee of R100 will be charged tohave your website(s) unsuspended once payment has been made.

No bills or invoices will be sent by regular mail. All invoices will be sentdirectly to customers via email shortly after the online purchase has beenmade.

If you pay by credit card or debit order it will be charged automaticallyon, or, shortly after the 1st or 15th of the month.
Failed debit orders / credit card transactions will be processed again on thefirst working day that falls on or after the 7th/15th of the month. Should thissecond attempt fail you will automatically be placed on eft and your accountwill be suspended until the account is paid in full via eft, not further debitinstructions will be processed for the account.

All payment is in South African Rands.

You are required to have a valid credit/debit card/bank account and emailaddress registered on your account at all times, failure to do so may result insuspension of your account.

Please note that whilst this is primarily used for billing purposes, Whizzihosting.co.zareserves the right to email your information about enhancements to our systemsand product offerings. Your email will not be passed to any other parties atany time.

Domain registrations

The client is welcome to register domains by themselves and have them hostedwith us.

If a domain is registered through us: we will be responsible for issuing aninvoice for the registration and renewal of the domain. In the case of co.zadomains, we invoice you for the domain, you are to pay us directly for thisregistration or renewal.

All domain registrations must be paid in advance.

All domains registered by us are registered on behalf of the client. andwill be the property of the client provided their account is in good standing.We reserve the right to 1) refuse the transferal of a domain or 2) delete thedomain from the registrar should your account be in arrears and be deleted fromour system.

An indication of a domain name being available during the order process isno guarantee that it will be secured for the client. As there is no guaranteethat the domain checking script is accurate due to variations in DNS records,or the domain name may be registered by another party between the time ofchecking and our request going through to the registrar.

Payment options

Whizzihosting.co.za currently runs the following payment methods.

Credit / Debit Cards: Whizzihosting.co.zaaccepts MasterCard, Visa
Debit Order: South African banks only.

Cash and Cash Bank Payments: Cashpayment will have a 1.5% handling fee.
EFT / Bank Transfers:

By submitting payment details to us (Credit card numbers / Debit orderdetails) you warrant and confirm that you are duly authorised to use thesupplied payment details.

30 day money back - trial period

For customers opening their first account the initial 30 days are availableon a money-back trial basis. For special promotions offered at discountedprices the trial period is limited to the initial 7 days. Customers will not beentitled to this benefit if they have previously had an account with whizzihosting.co.za.New customers will not be entitled to a trial period if any account haspreviously been created at the same postal address within the same 12 monthtime span.

Cancellation and refunds
Wizzihosting.co.za reserves the right to cancel the service at any time. Inthis event customers will be entitled to a pro rata refund based upon theremaining period of membership. If a customer contravenes whizzihosting.co.za'terms of service a refund will not be issued in the event of a cancellation.

Customers may cancel their account at any time provided that their accountis fully paid up. Your account balance can be viewedonline at www.greycell.co.za/billing

All account cancellations are processed within 24 Hours from thecancellation request. We do not schedule cancellations so please ensure thatrequests are sent on the day of intended termination.

During the initial 30 day trial period customers who wish to cancel will beentitled to a full refund for their hosting fees only, but will not be entitledto a refund for any additional services purchased. Any incentives offered tocustomers when opening the account will also be cancelled. Customers may begiven the option to purchase services which were offered as start-up incentivesin the result of a cancellation.

Fees charged on a prepay basis are non-refundable. Once the initial trial periodhas expired customers are not entitled to receive a refund unless the serviceis cancelled by whizzihosting.co.za as long as the cancellation is not relatedto service, spam related factors as mentioned earlier.

In addition some accounts incur set-up fees, domain registration fees, thesecharges are also non-refundable.

Indemnification

Whizzihosting.co.za reserves the right to refuse service and/or access toits servers to anyone. Whizzihosting.co.za reserves the right to move yourdomain to a different web server without previous notice. We will however makeevery effort to keep your sites uptime at 100% during this process.

Whizzihosting.co.za does not allow any of the following content to be storedon its servers:

• Adult material - includes allpornography, erotic images, or otherwise lewd or obscene content.
• Excessive download content ornon-linked content.
• Off-site backups.
• Practices relating/similar toDivination / the Occult / Astrology / Horoscopes / Crystal Reading.
• Spam, Phishing and any suchillegal activities.

Refusal of service based on content matching either of these criteria isentirely at the discretion of whizzihosting.co.za.

Customer agrees that it shall defend, indemnify, save and hold whizzihosting.co.za,associated members, employees and suppliers harmless from any and all demands,liabilities, losses, costs and claims, including reasonable attorney's feesasserted against any of the above mentioned, its agents, its customers,officers and employees, that may arise or result from any service provided orperformed or agreed to be performed or any product sold by customer, itsagents, employees or assigns. Customer agrees to defend, indemnify and holdharmless whizzihosting.co.za against liabilities arising out of; (1) any injuryto person or property caused by any products sold or otherwise distributed inconnection with whizzihositng.co.za' server; (2) any material supplied bycustomer infringing or allegedly infringing on the proprietary rights of athird party; (3) copyright infringement and (4) any defective products sold tocustomer from whizzihosting.co.za' server.

Whizzihosting.co.za will not be responsible for any damages your business maysuffer. whizzihosting.co.za makes no warranties of any kind, expressed or impliedfor services we provide. Whizzihosting.co.za does back up your data/website andwhilst every attempt would be made in the unlikely event of any corruption orhardware failure, Whizzihosting.co.za cannot guarantee to be able to replacelost data. Whizzihosting.co.za disclaims any warranty or merchantability orfitness for a particular purpose. This includes loss of data resulting fromdelays, non deliveries, wrong delivery, and any and all service interruptionscaused by Whizzihosting.co.za and its employees. Whizzihosting.co.za reservesthe right to revise its policies at any time.
